1. Acceptance of terms

These Terms & Conditions ("Terms") govern your use of the Yuki Bird SMS notification program and related services ("Service") operated by Surreystreet AI ("we," "us," or "our") on behalf of Yuki Bird Properties. By opting into SMS notifications or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference.

If you are using the Service on behalf of a property owner or organization, you represent that you have authority to bind that party to these Terms.

2. SMS messaging program terms

Program description

• Sender: Yuki Bird Properties, operated by Surreystreet AI
• Purpose: Property management alerts including security notifications, guest access events, lock status updates, and responses to your inbound SMS queries
• Message frequency: Varies based on property activity. Typically 2–10 messages per week.
• Charges: Message and data rates may apply. Contact your wireless carrier for details.

Opt-in

You may opt into the SMS program by completing the consent form at surreystreet.ai/consent. By opting in, you confirm that you are the authorized user of the mobile number provided and that you consent to receive recurring automated SMS messages from Yuki Bird. Consent is not a condition of any purchase or service.

Opt-out

You may opt out at any time by replying STOP to any message. You will receive one final confirmation message and no further SMS messages will be sent. Opting out does not affect your ability to use other Yuki Bird services.

Reply HELP to any message for assistance, or contact us at [email protected]. Supported carriers include but are not limited to: AT&T, Verizon, T-Mobile, Sprint, Boost Mobile, US Cellular, and Metro PCS.

Accuracy of mobile number

You are responsible for providing an accurate mobile number at opt-in. If your mobile number changes, you must opt out of the old number and re-enroll with your new number.

3. Permitted use

The Service is provided for lawful property management purposes only. You may use the Service to receive automated property notifications, send inbound SMS queries, and manage guest access through the Yuki Bird platform.

4. Prohibited conduct

You agree not to use the Service to:

• Send unsolicited commercial messages or spam through the Yuki Bird number
• Attempt to reverse engineer, copy, or replicate the Yuki Bird system
• Circumvent security measures or access controls
• Use the Service for any unlawful purpose or in violation of any applicable law
• Impersonate Surreystreet AI, Yuki Bird Properties, or any other person or entity
• Interfere with or disrupt the integrity or performance of the Service

5. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. SURREYSTREET AI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. SMS DELIVERY IS SUBJECT TO CARRIER AVAILABILITY AND NETWORK CONDITIONS OUTSIDE OUR CONTROL.

Yuki Bird is an AI-assisted service. While we strive for accuracy, automated responses may occasionally be incorrect or incomplete. Critical property decisions should be verified through direct human communication.

6. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SURREYSTREET AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO SURREYSTREET AI IN THE THREE MONTHS PRECEDING THE CLAIM.

7. Indemnification

You agree to indemnify, defend, and hold harmless Surreystreet AI, Yuki Bird Properties, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service or your violation of these Terms.

8. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.

9. Changes to these terms

We may update these Terms from time to time. We will notify opted-in SMS users of material changes. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
